Welcome to Box of India. These Terms of Service ("Terms") govern your use of our website at boxofindia.com.au, our mobile application, and our services in Australia. By using our services, you agree to be bound by these Terms.

Box of India is a brand operated by Liv247 The Grocer Australia Pty Ltd (ACN 680 504 625, ABN 81 680 504 625), a company registered in Australia. References to "we," "us," or "our" in these Terms refer to Liv247 The Grocer Australia Pty Ltd.

1. Acceptance of Terms

By accessing or using the Box of India website or app, you confirm that you accept these Terms and our Privacy Policy. If you do not agree, please do not use our services.

2. Changes to Terms

We may modify these Terms at any time. The most current version will always be available on our website with an updated effective date. By continuing to use our services after changes are posted, you accept the updated Terms.

3. Service Description

We provide an online platform for purchasing Indian grocery products in Australia, with delivery from our fulfilment centres in Sydney, Newcastle, and Melbourne. While we strive to keep product information, pricing, and availability accurate, we make no representations or warranties beyond those required by law about the completeness, accuracy, reliability, suitability, or availability of products or services.

Product availability and delivery options vary by location. Fresh and frozen products are currently only available in Sydney metro areas. See our Shipping Policy for details.

4. Eligibility & Accounts

  • Eligibility: You must be at least 18 years old, or have the supervision of a parent or guardian, to place an order.
  • Account creation: You must provide accurate and complete information when creating your account.
  • Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Notification of unauthorised use: Please notify us immediately at support@boxofindia.app if you suspect unauthorised access to your account.

5. Ordering & Payments

  • Order acceptance: We reserve the right to accept, decline, or limit any order for reasons including product unavailability, pricing or description errors, or order verification concerns.
  • Pricing: All prices are listed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to correct any pricing errors.
  • Payment terms: Payment is due at the time of order. Orders will not be processed or shipped until payment has been received.
  • Delivery: Delivery timelines, charges, and zones are described in our Shipping Policy.

6. Cancellations, Returns & Refunds

Orders may be cancelled, returned, or refunded in accordance with our Refund Policy. Nothing in these Terms limits the rights you have under the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

7. Intellectual Property

All content on the Box of India website and app — including text, graphics, logos, images, product descriptions, and software — is owned by or licensed to Liv247 The Grocer Australia Pty Ltd and is protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute, or modify any content without our prior written permission.

8. User Conduct

You agree not to use our services to:

  • Conduct or promote any unlawful activities
  • Infringe on the intellectual property rights of Box of India or others
  • Upload or distribute viruses, malware, or any malicious code
  • Collect or harvest information about other users without their consent
  • Interfere with the proper functioning of the website, app, or services
  • Attempt to gain unauthorised access to any systems or accounts

9. Promotions, Discounts & Loyalty

Promotional offers, discount codes and loyalty rewards are subject to any terms communicated at the time of the offer. Store credit is governed by section 10 below. We reserve the right to amend or withdraw any promotion at any time, without prior notice, where permitted by law.

10. Store Credit

10.1 What store credit is. Store credit is a promotional benefit we may make available to customers shopping with Box of India. It is not a gift card, is not purchased, has no cash value, cannot be exchanged for cash, and is not transferable between customers or accounts. Store credit is applied automatically at checkout against a future order and expires on the date stated when it is issued.

10.2 The spend-reward ladder. From time to time we offer store credit when the value of goods in a single order reaches a published threshold. Where such an offer applies:

  • the amount of credit is determined by the final value of goods in that order, excluding delivery fees and any other charges;
  • one credit is issued per order — the thresholds are not cumulative and do not combine;
  • the credit is issued after the order is completed, and may be withheld if the order is cancelled, refunded, or substantially reduced after issue;
  • we may change, suspend or withdraw the ladder, including its thresholds and amounts. Any change takes effect only from the time it is published on this page, applies only to orders placed after that time, and does not affect store credit already validly earned.

10.3 Personal and household shopping only. Store credit offers are made for personal, domestic or household shopping. They are not available for orders that are commercial, trade, wholesale or resale in nature.

An order is treated as commercial or trade for this purpose where one or more of the following applies:

  • the goods are acquired wholly or partly for resale, or for use in a business (including a café, restaurant, caterer, market stall, retailer or other food business);
  • the customer requests a tax invoice in a business name, provides an ABN/GST number, or has the order delivered to commercial or industrial premises, in circumstances indicating a business purchase;
  • the order contains six (6) or more units of the same product in a bulk or catering size (a “bulk size” being a single unit of 5 kg / 5 L or greater);
  • the customer places repeated orders of a similar bulk composition such that the overall pattern is inconsistent with personal, domestic or household consumption.

Where none of the above applies but the surrounding circumstances clearly indicate a business purchase, we may treat the order as commercial acting reasonably and on identifiable grounds, and will tell the customer those grounds on request.

We recognise that many households buy staple goods such as flour, rice, oil, ghee and pulses in large sizes, and buy in greater volume around festivals. Buying large pack sizes, or buying a lot at once, does not by itself make an order commercial.

10.4 If we treat an order as commercial. We will tell the customer, explain why, and not issue store credit for that order. The order itself is unaffected — the goods are supplied, and the customer’s rights in respect of those goods are unaffected. A customer who disagrees may contact us and we will review the decision.

10.5 Anti-avoidance. We may decline to issue store credit, or withdraw store credit that has been issued but not yet used, where a store credit offer has been deliberately circumvented — for example by splitting a single purchase across multiple orders or accounts to reach a threshold, by using multiple accounts controlled by the same person or household to multiply credits, or by acquiring goods for resale. We will only do so where there is a clear and identifiable basis, and we will tell the customer what that basis was. Store credit that has already been applied to a completed order will not be reversed.

10.6 Discretionary credits. Separately from the ladder, we may issue store credit at our discretion — for example as a goodwill gesture, service recovery, or as part of a win-back or marketing campaign. These credits are made available on the terms stated at the time of issue, expire on the date stated, carry no cash value, and confer no entitlement to any further credit.

10.7 Your statutory rights.

Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Store credit is provided in addition to, and does not limit, those rights.

11. Limitation of Liability

To the maximum extent permitted by law, Liv247 The Grocer Australia Pty Ltd will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, our services — including loss of profits, data, goodwill, or other intangible losses.

Nothing in this clause limits or excludes liability that cannot be limited or excluded by law, including under the Australian Consumer Law. Where consumer guarantees apply, our liability for breach of a guarantee is limited (to the extent permitted by law) to the replacement or supply of equivalent goods, repair, or the payment of the cost of replacement or repair.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of New South Wales.
